The Kumasi High Court has recognized Akosua Serwaa and Odo Broni as the surviving wives of highlife legend Daddy Lumba, ending the legal dispute over who can perform widowhood rites.
Delivering the judgment on Friday, November 28, Justice Dorinda Smith-Arthur disclose that the evidence brought to court validates that Priscilla Ofori, popularly known as Odo Broni, had been customarily engage to the late musician.
“The Abusuapanyin must acknowledge both Akosua Serwaa and Odo Broni as surviving wives of Daddy Lumba during the widowhood rites,” the judge directed, adding that no one should obstruct arrangements for the removal and burial of the musician.
Consequently, the court refused to declare Akosua Serwaa Fosuh as the sole surviving spouse, ruling that she had failed to prove her exclusive claim beyond reasonable doubt.
Earlier in the proceedings, the court threw out an injunction application filed by Akosua Serwaa that sought to halt funeral preparations in favor of the extended family. The judge reiterated that, under Ghanaian customary law, a deceased person’s body and burial rites rest with the matrilineal family.
